'active' layer dismiss does not block identify requests

If a layer is turned on in the data tab, but off in the active tab, it still seems to trigger an identify request

Please see screenshot, where the COAs were turned on in the data view, but then off in the active view. I was trying to identify a stream, and it kept selecting a COA boundary.
